Culturally Competent, Inclusive Fiduciary Support for Every Individual and Family
We Safeguard Your Family's Legacy With Unbiased Guidance
Licensed fiduciaries who understand the cultural, legal and financial hurdles that Black, Latinx, Asian-American and Native families still face.
Historic discrimination, lack of culturally competent advisers, and wealth-gap pressures mean many families of color miss out on probate-saving tools. We close that gap.
29% of Black adults and 27% of Hispanic adults have a will.
77% of Black adults and 82% of Hispanic adults lack any estate plan.

Common Questions
Yes—if three conditions are met:
- Eligible heir – You (or your siblings) must be a child of the owner —or a grandchild if your parent is deceased. boe.ca.gov
- Move-in & file on time – The home must become your primary residence within one year and you must file the Homeowners’ (or Disabled Veterans’) Exemption plus BOE-19-P claim within three years. boe.ca.gov
- Value cap – You keep the exact base-year value plus $1,044,586 for transfers that occur between Feb 16 2025 and Feb 15 2027 (the cap adjusts every two years). aws.boe.ca.gov
If the market value exceeds that cap, only the excess portion is reassessed; the rest keeps Mom or Dad’s tax base.
California probate treats foreign and U.S. heirs the same—they can inherit real estate or other assets without extra state taxes. aldenlawfirm.com
Practical hurdles do pop up:
- Overseas heirs must sign documents before a U.S. consulate or Hague-approved notary.
- The estate may need to obtain an ITIN for a non-resident so sale proceeds can be reported to the IRS.
- When the house is sold, federal FIRPTA withholding can apply; a professional fiduciary can withhold and file the right forms on the heir’s behalf.
A local, court-approved fiduciary keeps communication flowing, handles U.S. tax reporting, and wires net proceeds abroad in compliance with banking rules.
Planning documents: Anyone—citizen, permanent resident, visa holder, or undocumented—can sign a valid California will, trust, power-of-attorney, or health-care directive.
Tax rules:
- A non-citizen spouse does not automatically receive the unlimited federal estate-tax deduction; most couples solve this with a Qualified Domestic Trust (QDOT).
- Non-resident owners are subject to U.S. estate tax only on U.S.-situs assets, but California has no separate estate tax.
- Immigration status never stops property from passing under a trust or probate order, but cross-border heirs should expect extra IRS reporting (Forms 3520/8938).
A culturally competent attorney + professional fiduciary can tailor your plan so citizenship nuances don’t derail tax savings or asset transfers.
Absolutely. Pride Trust Services provides:
- Bilingual team members and certified interpreters for most languages can be provided.
- Key engagement letters, fee schedules, and court notices translated at no extra cost.
- Video-conference options that let overseas or non-English-speaking family members participate in real time.
Just tell us your preferred language when you book, and we’ll make sure every step—from intake to final accounting—is crystal-clear.
We charge the hourly rates (or statutory percentages for probate estates) spelled out in your engagement letter, log every task in detailed time sheets, and then file a fee petition with the probate court. The judge reviews those records and authorizes payment only if the work and amount are reasonable, so nothing is paid until the court signs off.
